Young offender under parents’ watch

A MOUNT Gambier man charged with a serious assault offence has failed to have the curfew condition lifted on his bail agreement with the defendant only allowed out at night accompanied by his parents.

Giacobbe Tzioutziouklaris, 22, appeared in the Mount Gambier Magistrates Court to make an application to have his bail adjusted.

Tzioutziouklaris is currently on bail awaiting sentence in the March Mount Gambier District Court circuit after he pleaded guilty to a charge of assault causing harm.

The prosecution said the incident occurred at a city nightclub when the defendant struck another person to the side of the head, knocking him unconscious.

At the time of the offence, Tzioutziouklaris was on a District Court imposed suspended sentence bond, which included a condition requiring him not to attend licensed premises.

Magistrate Teresa Anderson said the offending showed the defendant was non-compliant with court orders and she would not be able to trust him to comply if she removed the curfew condition.

She said she would only allow Tzioutziouklaris to be out of his home between 10pm and 6pm if it was for work purposes or in the company of his parents.

“I am not prepared for him to be roaming around Mount Gambier unless it is with you or your wife,” Magistrate Anderson told the defendant’s father in court.

The defendant’s lawyer said she accepted the magistrate’s position and they would have to “take what they can get” at this time.

Magistrate Anderson required the defendant’s father to lodge $1000 to the court as a cash guarantee to make his son comply with the new terms of the bail.
