A Mount Gambier man who drove disqualified has been jailed after the offending breached a suspended sentence bond.
Anthony Lawrence Orcher appeared in the Mount Gambier Magistrates Court on Tuesday to be sentenced for the offending.
The man was stopped by police when he was driving in Mount Gambier on April 3.
Checks revealed he was driving disqualified.
The court heard the defendant had a long history of driving disqualified in Queensland and New South Wales.
He had recently moved to South Australia and defence counsel said he became confused about the status of his disqualification.
Orcher attended the customer service centre which indicated it would make more enquiries about the issue.
However, Orcher decided to drive, despite not having a licence.
The defendant’s lawyer said his client accepted he was disqualified at the time, despite his confusion.
The court heard Orcher was driving someone to work when he was pulled over.
Magistrate Teresa Anderson said the offending was particularly serious because Orcher was already on a suspended sentence bond for an assault committed last year.
“You showed complete disregard for a court order,” Magistrate Anderson said.
“You have an appalling history and have not been deterred from driving.”
Magistrate Anderson found no good reason to excuse the breach of the suspended sentence bond, calling into effect three months and three days imprisonment.
She also sentenced the defendant to a further two months and 12 days imprisonment for the fresh offending.
Magistrate Anderson showed some leniency to Orcher, by having the sentences run at the same time, meaning the defendant would only spend three months and three days behind bars.
