Defendant recalls ‘no memory’ of break-in

A MILLICENT man who smashed a window and climbed into the local veterinary clinic said he cannot remembering the incident occurring at all.

The 31-year-old appeared before the Millicent Magistrates Court earlier this month after he was charged with serious criminal trespass and property damage.

Some time during the hours of December 16 and 17 the defendant broke into the clinic, however there was no evidence he moved, touched or stole anything from inside.

The defendant’s lawyer said her client suffered from mental illness and at the time of the incident he had not been taking his medication, which caused him to fall into a psychotic state.

Magistrate Anderson questioned whether it was the defendant’s misuse of medication or his methamphetamine use that was the reason for his behaviour.

“We need to find out whether it was the chicken or the egg … are the drugs the cause of your behaviour or is it a result of not taking your medication?” she said.

She added the charges against the defendant were “not quite right”.

“It is intent to enter the premises not serious criminal trespass as nothing was disturbed inside.”

The defendant was ordered to attend a drug intervention program and the matter was adjourned until May 23.
