AMIDST speculation about the closure of Gambier City Bowl, Bill DeGaris, lawyer for and spokesman for the landlord, Admill Nominees Pty Ltd, confirmed the landlord served a rental arrears notice on the tenant in mid-December last year.
That demand for payment of rental arrears was not met and under the Warrant of Distraint served on the tenant the building was locked up to preserve the assets.
“The landlord has not shut down the business as has been portrayed on social media,” Mr DeGaris said.
“The tenant has failed to meet rental commitments and the landlord has exercised its rights under the Landlord and Tenant Act to recover rental due.
“The landlord has advertised public auction to take place on Monday 26th of February.
“A full list of items listed for sale has been advertised in The Border Watch.
Those items which are not items owned by the landlord cannot and will not be sold in the auction process.”
Many people have enquired about personal goods held at the bowl in lockers.
The landlord has advised those who have enquired the centre will be reopened Saturday morning between 9am and 10am for people with personal possessions in lockers to collect those possessions and leave the locker keys at the facility.
“If anybody has any queries about the goods which will be for sale and the auction process, they should keep an eye on the Border Watch next week for full details,” Mr DeGaris said.
“Those wishing to inspect items for sale will be afforded that opportunity on Wednesday and Thursday next week between the hours of 4pm and 5pm, or as may be otherwise arranged directly.”
