Jail term avoided

A MILLICENT man who grabbed a police officer by his vest when they were attempting to detain his partner has received a suspended sentence and been ordered to complete community service.

Cody John Davis, 21, appeared in the Millicent Magistrates Court to be sentenced for assaulting police and to be re-sentenced for breaching a good behaviour bond.

The prosecution said on Septemeber 3, officers attended at a premises to detain a young female for hospitilisation.

Davis – the woman’s domestic partner – returned to the house and became agitated with the situation.

As officers attempted to escort the woman from the house, Davis grabbed one of their vests and attempted to stop them, constituting the police assault.

Davis was also re-sentenced for an incident involving a woman on January 2.

The victim met with Davis to have her iPpad returned and became involved in an argument.

Davis threw a cigarette lighter at the victim, which hit her in the thumb.

The victim then took the Ipad and ran away, however she was chased by the defendant.

When Davis caught up with her, he pushed her to the ground and began to struggle over the iPad.

The iPad’s screen was cracked in the incident.

Magistrate Teresa Anderson cited the defendant’s anger problems.

“Anger issues have existed for you since a fairly young age as you were expelled from school in year nine,” Magistrate Anderson said.

She expressed a desire to give him the tools to deal with his anger issues.

As a result she sentenced him to five weeks imprisonment, but suspended it on him entering a 12 month good behaviour bond to be supervised for eight months.

She also ordered him to complete 60 hours of community service within six months.
