Legal scrap continues over asbestos dump

IN LIMBO: A proposal to dump asbestos at the Sandyridge Landfill continues to be embroiled in legal matters.

A LEGAL stand-off between a Warrnambool contractor and Grant District Council continues over a proposed asbestos dump along Cafpirco Road on the edge of Mount Gambier.

This follows the owner of Sandyridge Landfill wanting to dump asbestos at the site.

Council – which is fighting to stop the proposal – has directed the developer to lodge a new development application.

But the legal team working on behalf of the developer has requested council to advise the Environment Protection Authority it no longer requires its client to lodge a fresh application.

Council environmental services director Leith McEvoy said council had remained firm on the issue.

“Council maintains its position that a development approval is required before the receipt and disposal of asbestos can lawfully occur on the land,” Mr McEvoy said.

“No response has yet been received to the letter from council’s lawyers.”

Council is working to stonewall the proposal following an outcry from residents near the landfill.

The quarry was approved by the former Mount Gambier and District Council in 1984 as a solid waste dump.

While the landfill had received ongoing approval from the EPA, it has a new owner who wants to vary the conditions to include the receival and disposal of asbestos.

The site was recently purchased by a demolition contractor based at Warrnambool.
