Accused murderer has home detention bail condition lifted

A TEENAGER charged with the murder of Bordertown man Rex Court has had the home detention condition of his bail lifted with no opposition from the Director of Public Prosecutions.

The 15-year-old boy, who is now charged with murder and assault causing serious harm, appeared in the Adelaide Youth Court today.

The charges relate to the murder of Mr Court, a 32-year-old father of three, which occurred during a fight on Commercial Street East, Mount Gambier at around 9pm on May 13.

A document was filed by defence counsel outlining the defendant’s full compliance with home detention bail to support the application for the condition to be lifted.

The new agreement will see the boy on bail in the sum of $1000 with normal residential conditions and under the supervision of youth justice.

Magistrate Kym Boxall asked prosecution if they required a curfew condition, however no order was made.

A bundle of declarations was also filed in court this morning, however the prosecution is still awaiting postmortem and DNA reports.

They are expected to have both reports by the middle of November.

The matter was adjourned until December 8.

Von Stanke brothers Dominic, 20, and Jordan, 23, were also charged with murder in relation to the same incident and are currently in prison while they await court proceedings.

Defence counsel for the pair have made two applications for bail, however were unsuccessful on both occasions.

Prosecutors strongly opposed the application due to the seriousness of the charge while the defendants’ lawyers argued self-defence could be raised as a legitimate defence to the charge

During the bail applications, the court heard it took the men just 39 seconds to spear tackle a man, throw him to the ground “with a cracking sound” and inflict ultimately fatal kicks and stomps.

Both men are yet to enter pleas to the charge and have been remanded to appear in the Adelaide Magistrates Court on September 28.
