Bail report ordered over death threats

A COMPREHENSIVE bail report has been ordered for a Mount Gambier man who was found in possession of a sawn-off shotgun following threats to kill his former partner.

Evan Brook, appeared in the Mount Gambier Magistrates Court in police custody after being arrested for the offence at his home.

Around a week ago, the defendant told the other occupant of his premises that he planned to kill his former partner and her children.

As a result, the occupant moved the firearm from the safe to a secluded spot in the shed of the house.

The witness also advised Brook’s ex partner of the threats that we made against her.

Police searched the premises after Brook’s former partner notified them he was in possession of a firearm.

During the search police also located five tasers, three of which were homemade.

The prosecution said police had found Brook in possession of tasers on two other occasions.

It was also revealed the defendant had no licence to hold a firearm.

“We have no confidence that he will abide by bail conditions,” the prosecution said.

“The community and his ex-partner need protection of the court.”

The defendant’s lawyer said the property is shared by Brook and the other occupant and questioned the strength of the allegation.

“He was never in possession of the firearm,” the defendant’s lawyer said.

“It is a convenient suggestion by the witness in this case.”

Magistrate Maria Panagiotidis refused to grant simple bail for the defendant and ordered a comprehensive bail enquiry report.

The matter is listed again on Thursday.
