Home detention for disqualified driver

A MOUNT Gambier man who drove disqualified will serve a three month prison term on home detention after being sentenced in court on Wednesday.

Benjamin Rhys Rowe, 25, appeared unrepresented in the Mount Gambier Magistrates Court to be sentenced for driving disqualified.

The prosecution said Rowe was stopped driving in the city at around 10.15am on June 19.

Checks revealed he was driving disqualified and the defendant said he was aware of the order.

Rowe told police he had just fixed the transmission in the vehicle and was testing it.

When asked in court why he thought it would be fine to drive, Rowe could not provide an explanation.

“It was stupid, I was not thinking,” he said.

Magistrate Teresa Anderson said the order was imposed in court just 19 days before he decided to drive again.

“I would be suggesting that you couldn’t have cared less about the order, do you agree?” Magistrate Anderson asked.

“Yes,” the defendant replied.

Magistrate Anderson said the offending showed complete disregard for the order of the court and was the second time Rowe had driven disqualified, making it a serious matter.

“You accept that I warned you,” Magistrate Anderson said.

“You have told me you have got rid of your cars and your mother has pulled you into line.”

Rowe was convicted and sentenced to three months imprisonment, which he would be allowed to serve on home detention.
